Host Here offers web hosting services in Sri Lanka. We are committed to protecting our clients and providing top-quality services. By using any services offered by Host Here, you agree to comply with these terms of service

1. Billing and Refunds

  • Payment Terms: We offer monthly and annual billing cycles based on your chosen hosting plan.
  • Trial Period: We offer a one-week trial period during which you can evaluate our services without any payment.
  • Refund Policy:
    • Eligibility for Refunds: Refunds can be requested within 30 days from the payment date under the following conditions:
      • Non-performance of service: If the services are continuously non-operational, not including planned or unplanned maintenance periods.
      • Service unavailability: If your web hosting service fails to go live within 48 hours of purchase due to a fault on our part.
      • Overbilling: If you were charged more than the advertised price due to a billing error on our part.
      • Significant misrepresentation: If the features and benefits of the service are significantly misrepresented on our website or through our marketing materials.
      • Product defect or failure: If a critical aspect of the service is faulty or fails to function as promised and cannot be promptly corrected.
    • Exclusions: Refunds are not available in the following scenarios:
      • Change of heart: If you decide you no longer want the service, refunds are not available. However, you can always upgrade or downgrade your services.
      • Monthly Payment Cycle Services: Refunds are not available for services billed on a monthly payment cycle.
      • Transactions Below Rs. 2000: No refunds will be provided for transactions below this amount.
      • Domain name registrations and renewals.
      • Licenses, including those for software and VPS.
      • Custom software installations and administrative services.
      • Accounts cancelled or suspended due to policy violations, including breaches of our Acceptable Use Policy.
      • Minor downtime or issues that fall within our Service Level Agreement (SLA) tolerances.
      • Services modified or fully consumed before the refund request (e.g., bandwidth or data usage).
    • Refund Method: Refunds will be processed via the original payment method minus any applicable banking fees and used credits. If the original payment method does not support refunds, a bank transfer will be used.
    • Processing Refunds: Refunds will be processed within 30 days of approval. Clients must formally request a refund by contacting our support team and providing detailed reasons for the request, including relevant documentation or evidence of the issue where applicable.
    • Additional Refund Details:
      • Timeframe for Refunds: Once a refund is approved, it will be processed and credited back to the original payment method within 7-10 business days, depending on the processing time required by the payment provider.
      • Required Documentation: To facilitate a swift refund process, clients are required to submit any relevant evidence supporting their refund request, such as error logs, screenshots, or detailed descriptions of the issue encountered.
      • Refund Eligibility After Account Cancellation: Clients can request a refund within 14 days following account cancellation, provided the cancellation falls within the eligible refund period.
      • Usage Thresholds: Refunds may not be granted if the client's usage exceeds a certain percentage of the allocated resources (e.g., more than 50% of monthly bandwidth or storage) before the refund request is made.
  • Accepted Payment Methods: We accept payments via credit/debit cards, eZCash, LankaQR, and wire/bank transfers.
  • Contractual Period: There are no minimum contract periods for any plans.

2. Late Payments

  • Shared & Reseller Hosting: If payment is not received by the due date, services will be suspended on the third day past due and terminated on the 25th day past due. A late fee of Rs. 200 or 10% of the overdue amount, whichever is higher, will be imposed if payment is not made by the seventh day past due.
  • VPS, Dedicated Servers, & Licenses: Services will be suspended on the due date and terminated five days after the due date if payment is not received. A late fee of Rs. 200 or 10% of the overdue amount, whichever is higher, will be added to your invoice. This fee must be paid to reactivate your service.

3. Discounts and Coupons

Discounts and coupon codes are available for both new and existing customers. Host Here has sole discretion in offering these discounts, and they may be applied towards any services including domain registrations unless otherwise specified. Misuse of coupons may lead to additional charges and potential suspension or termination of service.

4. Backup Policy

We provide free weekly backups for all cPanel-based services, retaining four backups and covering up to 7GB per account. Additionally, we keep three monthly backups. Users have the option to purchase daily or hourly backups or larger backup quotas as needed.

5. Acceptable Usage

All services must be used for lawful purposes only. Any content or activity that violates any applicable laws or our policies may lead to suspension or termination of services. Prohibited content includes, but is not limited to, illegal software, abusive material, phishing schemes, and harmful software.

6. Resource Usage

Services must not exceed the resources allocated to your account as specified in your service agreement. Excessive use of resources may result in suspension of your service.

7. Policy on Abusive Clients

Host Here may suspend or terminate services for clients who engage in abusive behavior towards our staff or disrupt our operations. Examples of such activity include verbal abuse (such as cursing, yelling, threatening), ongoing disregard for warnings or notices, spamming our email addresses or ticket systems, and causing unnecessary workload due to consistent errors or changes. Such behavior will be met with immediate suspension or termination of services.

8. Dispute Resolution

In the event of a dispute, Host Here will first attempt to resolve it through direct negotiation. Should these efforts fail, the dispute will be escalated to mediation. If mediation is unsuccessful, the dispute will be resolved through arbitration or in a court of competent jurisdiction, depending on the nature of the dispute.

9. Modifications to the Terms and Conditions

Host Here reserves the right to modify these terms and conditions at any time. Such modifications will be effective immediately upon posting the updated terms on our website. Continued use of our services after any such changes shall constitute your consent to such changes.

Host Here is not liable for any damages or losses your business may incur. We make no explicit warranties regarding the services provided. This includes data loss due to delays, non-deliveries, or service interruptions caused by Host Here and its employees.
